Welcome to Peak Web Innovations! 

1. Definitions

KnzDev:  The service provider offering website hosting, development, and marketing services.
Client/User:   Any individual or entity using Peak Web Innovations services.
Services:   Website development, hosting, marketing, SEO, and other related services provided by Peak Web Innovations.

2. Acceptance of Terms

By accessing or using Peak Web Innovations services, you accept these Terms and Conditions. If you do not agree, you must cease using our services immediately.

3. Services Offered

Website Hosting: Hosting plans and server space provided by Peak Web Innovations are subject to availability and specifications stated in the agreement.
Website Development: Custom website creation tailored to the Client’s needs.
Marketing and SEO Services: Strategies designed to improve online presence, including but not limited to SEO, paid advertising, and social media management.

4. Client Responsibilities

Accurate Information: The Client must provide accurate and complete information for the provision of services.
Content Ownership: The Client is responsible for the content uploaded or provided for their website. Peak Web Innovations is not liable for copyright infringement or illegal content.
Compliance: The Client agrees to use services in compliance with all applicable laws and regulations.

5. Payment Terms

Invoices: All services will be billed as outlined in the proposal or contract.
Payment Due: Payments must be made within the agreed timeline. Late payments may incur additional fees.
Refunds: Refunds are not guaranteed and will be reviewed on a case-by-case basis.

6. Intellectual Property

Ownership: KnzDev retains ownership of all code, designs, and intellectual property developed until full payment is received.
Licenses: Upon full payment, Peak Web Innovations grants the Client a non-exclusive, non-transferable license to use the website or materials as intended.

7. Hosting Terms

Uptime: While Peak Web Innovations strives for maximum uptime, we do not guarantee uninterrupted service.
Prohibited Use: Hosting services may not be used for illegal activities, spam, or malicious content. Violation will result in termination without notice.
Backups: Clients are responsible for maintaining backups of their website data. Peak Web Innovations may offer backup services at an additional cost.

8. Termination

By Client: The Client may terminate services with 30 days written notice.
By Peak Web Innovations: KnzDev reserves the right to terminate services for non-payment, breach of these Terms, or misuse of services.

9. Limitation of Liability

KnzDev is not liable for:
Indirect or consequential damages arising from service use.
Loss of data due to server downtime, hacking, or other unforeseen issues.

10. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary or sensitive information exchanged during the course of the relationship.

11. Governing Law

These Terms are governed by the laws of the State of Utah. Any disputes will be resolved in the courts of St. George, Utah.

12. Modifications

KnzDev reserves the right to update these Terms at any time. Clients will be notified of significant changes.
